Terms of the Competition
The competition will be operated by the promoter to which these terms and conditions apply, wherein the entrants submit entries via the website ‘winyourownitalianhouse.com’
First prize will be the house in Bugnara, L’Aquila. Second prize E5000 and third prize E1000 to each of five entrants.

Any person who enters the competition through the website to try and win the prize
The entrant chosen at random and who will receive the prize in accordance with these terms and conditions.
The start date of the promotion is 1st September 2020 at 12pm midday, GMT+2.
One year after the start of the competition or unless all tickets are sold prior to that date.
Maximum number of entries
By entering the competition the entrants are deemed to have read and accepted these terms and conditions and agree to be bound by them, upon entering the competition. All entrants must submit all contact details requested by the promoter (which must include a valid email address) which will be used for follow up purposes.

All entrants are solely and completely responsible for providing the promoter with the accurate and current contact details. The promoter will in no way be liable for any failure or inability to make contact with any entrant due to errors, omissions or inaccuracies in the contact details provided by the entrants.
The entrants and the promoter recognise that the promoter may use contact details and other data including personal data as defined by the Policy Act 1993 supplied by the entrants to the promoter to administer the website and conduct the competition according to these terms and conditions. The entrant and promoter also recognise that the promoters may (either by choice or at the request of third parties) also disclose this information to relevant third parties for the purpose of the prevention of fraud, money laundering, legal or other financial or regulatory reasons. The data will not be sold or used by other parties and will be used by the promoter to update entrant for the duration of the competition.
The competition is organised and run by the promoter.
The competition is open for entry to any persons 18 years of age or over. Entries made by the entrants to the competition will only be valid if made via the website.
By entering into the competition, all entrants acknowledge that their payment of E50 (Euro) per entry does not guarantee in any way they will win the prize. The Promoter does not in any way guarantee or make any perceived representation as to the value of the prize.
Only complete entries will be entered into the competition. As a condition of entering the competition, entrants must ensure that by doing so, they do not contravene any laws of their country of residence. The promoter will not be liable in any way if an entrant enters the competition unlawfully.
The entrants and promoters recognize that the transfer of ownership of the house is strictly governed by Italian law. Although the promoter comes from New Zealand and the website has been made in New Zealand, the sale of the house is strictly governed by Italian Law.
By entering the competition, entrants warrant that all information they submit is accurate, true and complete. The promoters reserve the right to disqualify any entrant (entirely at their own discretion) if there are reasonable grounds to believe the entrant has acted in breach of any of these terms and conditions.
There is no limit to the number of entries that any one person can make via the website.
The promoter reserves the right to amend these terms and conditions at any time for any reason.
Closing the competition
The competition will close on the specified date, unless all tickets are sold prior. In this case the draw will take place earlier and notification will be put on the facebook page and or website.
The purpose of the competition is to win the prize, a beautiful house in the medieval village of Bugnara in the region of Abruzzo, Italy. The prize will be transferred by the promoter to the winner, free from all charges and other encumbrances at the promoters expense, including all fees, charges, and Italian house purchase taxes. The promoter is not responsible for any taxes incurred in the entrants country for winning an overseas property. It is the entrants responsibility to know if any taxes are due because of this.
The winner shall ensure that the prize is registered at the local town hall and land registry in the winners name. Payment will only be accepted in Euros.
English is the only language in which an entrant may submit their entry.
The process to determine the winner will begin the day after the closing date or when all tickets have been sold, and a decision will be made within 7 days of that date. The cost of entering the competition is E50 per entry and is payable by using the ‘Enter to Win’ icon on the website. To conclude an entry into the competition the entrant will be asked to provide contact details (email address and telephone number) and payment details. Once the entry is submitted, the entrants payment will be acknowledged by a receipt sent via email on the entry form within several working days.
The promoter reserves the right to extend the closing date of the competition up to six months at their discretion or bring the closing date forward. All entries to the competition are final and no refunds shall be made at any time for any reason while the competition is in progress.
The winner of the prize will be the entrant whose ticket is randomly drawn in the presence of a Notary or other official. The promoters decision is final and no correspondence will be entered into about the result of the competition following the determination of the winner as described above. The winner will be required to forward a copy of their passport or driving license to the promoter to prove their identity and that their entry was belonging to the entrant or used with the express authorization of the card or funds holder. Each entrant agrees that the usual requirements under the Consumers Protection (distant selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to this competition.
If the winner cannot be contacted within 21 days of being notified of their status as winner by email or contact details submitted in their entry, the promoter shall be entitled to award the prize to the second prize entrant and subsequently the second prize will be awarded to the first drawn third placed entrant. The alternate winner will have 7 days from notification of their status by the promoters to communicate their acceptance of the prize.
The winner will be required to sign a transfer deed in the city of Lanciano, Italy in the office of the Notary Lucio Lalli, to transfer the property into the winner'(s) name within 28 days of being notified.
Special note – if for some reason the winner cannot travel to Italy for that time, a Power of Attorney will be granted to a lawyer who will then sign on behalf of the winner. In this case, the lawyer will finalize details on behalf of the winner and hold the keys until the winner can either collect them in person or have them sent by courier to the address on the entry form. This shall be determined at the time and if the situation arises.
Entrants authorize the promoter to enter their personal details into their database and to use the information in accordance with the provisions of the Privacy Act 1993 and subject to the terms of the private policy.
The promoter reserves the right to cancel the competition at any time either before or after tickets have been sold. If the competition is cancelled, the promoter will return the entry fees to each entrant. Where the entry fee is returned, the promoter shall have no further liability to the entrant or any other person.
The promoter makes no representation or warranty as to the value of the prize, its structure or cosmetic condition or its ability to be sold. Entrants should make their own enquiries and legal advice about the prize before entering the competition.
Save for death or personal injury, the promoter will not be liable for any loss suffered to or sustained by any person or property as a result of any act or omission of the promoter, nor with their servants or their agents in developing, planning and administering the competition, distributing the prize to the winner, or following distribution of the prize. The promoter accept no liability for errors or omissions contained within the prize details, description or specifications or any other part of the website. It is the responsibility of each entrant and particularity the winner, to satisfy themselves as to the accuracy of any such details and or content of this website.
The promoter will not be liable for any loss suffered by an entrant as a result of incomplete entries or failed computer communications or any loss suffered as a result of the website.
The promoter does not accept responsibility for entries which they do not receive due to failures in computer systems, other malfunctions, high internet traffic, hardware failure, software failure, server faults or any other reason.
The competition rules shall not be construed as creating any form of contract, joint venture or other agreement between entrants and the promoters.
Any entries shall be declared void (without any refund being given) if the entrant engages in a) any form of fraud (actual or apparent), b) fraudulent misrepresentation, c) fraudulent concealment d) hacking or interference with the proper functioning of the website or e) amending or unauthorized use of any of the code that constitutes the website.
Each entrant shall retain a copy of these terms and conditions for their future reference.
